At an elemantry school in california , a 5 year old girl throws a tantrum in her classroom. The teacher calls the principal, who brings the girl to the office. The little girls tantrum escalates and she begins to hit the principal. The principal proceeds to tie up the little girl and calls the police and her mother. The little girl is released once the police arrive. According to california law can the principal assert defense of discipline if an action for assault and battery is brought on behalf of the little girl by her mother?

Are there cases similar to what you described that were tried in a court of law? If so, what were the details? What were the verdicts of those trials?

Maybe, yes. But as we all know, that's a 5 year old versus an old man....we can't be sure of the outcome of the verdict...:-)
