At an elemantry school in california , a 5 year old girl throws a tantrum in her classroom. The teacher calls the principal, who brings the girl to the office. The little girls tantrum escalates and she begins to hit the principal. The principal proceeds to tie up the little girl and calls the police and her mother. The little girl is released once the police arrive. According to california law can the principal assert defense of discipline if an action for assault and battery is brought on behalf of the little girl by her mother?

ive searched & searched and can not find an appropriate answer

im not familiar with California law but i wouldnt think that kind of disciplne would be called for.

just like in a domestic dispute a mother or father could claim they used excessive force in order to control their child but the law will not see it that way. it will be seen as child abuse and the child will be taken into protective custody
