Grammatically, is it proper to say "This e-mail is presumed confidential" or "This e-mail is presumed to be confidential" I'm having trouble making my disclaimer precise but concise.

If you're presuming that it's confidential, why not just make the claim that it's confidential? I'm seriously asking what the logic is. I'd either go for "This email is presumed to be confidential" or just "This email is confidential," preferably "This email is confidential."
