Well i'd go with that but the problem is it is stuck in the tree it is not going no whare. Or does the flapping motion count?

For me, the wording implies that either the kite is blowing (moving around) while stuck in the tree or the entire is blowing/moving around...both of which mean the kite has kinetic energy.
