Nancy was raped while she was a student at Virginia tech university and sued the university under the federal law "violence against women Act of 1994." The defendant challenged the legality of the federal law on the basis that there was no nexus between sexual violence and interstate commerce. Is the defendant correct? PLEASEE HELP
anyonee please??
I think the University as the defendant is correct is stating that there is no connection between sexual violence and the university as a business. Basically the University is claiming that it is not responsable for any liability of someone being raped because they provide education, on campus police --in essence the University has made a notable investment into preventing rape but some how this woman became a victim - the University position is that it did what it could to prevent anything from happening to a reasonable extent - But it is not liable to be sued for financial restitution.
