The Judiciary Act of 1789, You might be tempted to say Article III of the Constitution, which is the authority for the Federal Court system, but Article III itself only specifies the existence of the Supreme Court "and in such inferior Courts as the Congress may from time to time ordain and establish." So it was up to Congress to actually set up the Court system. There is no Judiciary Act of 1987. I guess that was put in there to test whether you are dyslexic or not sure what century you live in.
