Freedom of speech

OpenStudy (anonymous):

Why do you keep asking constitutional questions in math?

OpenStudy (anonymous):

meaning like you do have to talk in if they ask you something then you say I plead the 5th amendent

OpenStudy (anonymous):

And no it is NOT "freedom of speech" It's the right to not incriminate yourself.

OpenStudy (anonymous):

it is freedom of speech "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

jimthompson5910 (jim_thompson5910):

the first amendment is the freedom of speech

OpenStudy (anonymous):

its the right to remain silence. If a cope picks you up you dont need to talk 2 them if you dont want 2

jimthompson5910 (jim_thompson5910):

the fifth amendment is the right not to incriminate oneself

jimthompson5910 (jim_thompson5910):

it's all on that page I gave you arianadarsh

OpenStudy (anonymous):

Because they don't want someone to know their secret! Which may implicate someone else.

OpenStudy (anonymous):

OpenStudy (anonymous):

Right back atcha, Jim, for that link you posted for her in her last question. :-)

OpenStudy (anonymous):

Because they dont want to answer a copes question

OpenStudy (anonymous):

The 5th ad. "Sets out rules for indictment by grand jury and eminent domain, protects the right to due process, and prohibits self-incrimination and double jeopardy"

OpenStudy (anonymous):

I don't know why they do it, but I do know that more people should !!

OpenStudy (anonymous):

I just said that I'm right lol

OpenStudy (anonymous):

I am having a quiz on amendments and the 5th amendment is Due process of law, which means you cant be deprived of your right to life, liberty, or property without due process but you've been DULY processed.

OpenStudy (anonymous):

@arianadarsh Don't listen to people who think the FIRST amendment is the reason people invoke the FIFTH amendment. People plead the 5th when they are being questioned and they don't want to give the questioners any information they can use against you. (This is the back bone of the "Miranda law", BTW) You aren't allowed to lie to an investigative authority (to do so is called "obstruction"), but you ARE allowed to keep your mouth shut and not answer ANY questions asked of your relationship to a crime.

OpenStudy (anonymous):

Yea, it's basically saying let the cops do the work to prove your guilty, you shut up and let them do the work and dont say a word, thats why when cops arrest people they say "you have the RIGHT TO REMAIN SILENT anything you say or do will be held against you in the court of law.." theres more but thats the point.

OpenStudy (anonymous):

YOU have the CHOICE to plead guilty, you cannot be forced to.

OpenStudy (anonymous):
