As the graph doesnt touch the x axis it means the quadratic has not got any roots .This means discriminant<0 .Can you do it now?

Oh! I see, as long as it doesn't touch the x axis the discriminant might turn out to be 0?

Nope when discriminant=0 there is only one root .The graph touches x axis exactly at one point. When D>0 there are two roots so graph cuts x axis at 2 points.The case where D<O graph floats above/below x axis as shown in your figure
