Actually I take back my statement that is correct, I was thinking of something different. While the senate did not give direct advice to the citizens it gave advice to magistrates to pass laws. This "advice" was called senatus consulta, which translates to advice, so you could say they gave advice. While these senatus consulta did not hold any legal value, it was like a push to the magistrates to pass that bill.
