Because technically The first Document ever published by the USA as a separate country would be the Declaration of Independence but the first major legislation/form of government passed by the US after the Revolutionary War was the Articles of Confederation. There were about nine "presidents in between the Articles and the Constitution and then when the people realized how weak the Articles really were they got together to form the Constitution which is what we still work under today.
