Without having background checks on the people who buy the guns, how do we know that we're not just giving the gun to a past murderer or something?

Running background checks on people will show their criminal history, so if they are a criminal, yes, this will keep them out of the militia.

It doesn't really matter about their identity. Like, their name. 
It matters as if they have criminal history or not.
