Why did the Emancipation Proclamation free slaves only in Confederate states? President Lincoln did not have the authority to remove property from U.S. citizens. President Lincoln did not have the authority to naturalize Northern freedmen into citizens. Northern legislatures had already passed legislation blocking emancipation. Northern legislatures had already passed the Emancipation Proclamation.

Lincoln freed the slaves in the Confederate States, because they were in rebellion against the Union. Causing most of the Civil war, Lincoln decided to make the Emancipation to abolish the rebellion and keep the Union stable.
