PLEASE HELP!!!!!!! the constitution states that "no new state shal be formed or erected within the jurisdiction of any state without the consent of the legislatures of the states concerned as well as of the congress". yet in 1863 west virginia was asmitted as a state without virginias consent. WHY?

Virginia refused to stay in the Union while West Virginia remained in the Union.
