I'm pretty sure it's D because I know the vice president kind of acts more as an advisor to the president ant judges are in a court judging cases like murders or theft and such, while A won't work either because we would be voting all of the time if it was up to a vote by the people. And D makes the most sense because when Lincoln wanted to pass the thirteenth amendment he had to get 2/3 of both houses of congress to vote for him
