Homework Essay Question: Why is the power of Judicial Review antidemocratic? For the essay, I need three reasons why it is anti democratic. I don't know if reviewing courts adopted policies that the disfranchised majority likes is a reason. Please help asap. I need help in writing those 3 reasons into my intro paragraph of my essay.
okay so a JR is a procedure by which a court can review an administrative action by a public body and (in England) secure a declaration, order, or award.
anti-democratic means in conflict with the principles of democracy.
so basically you wanna find and use examples of why a JR is against democracy
okay :) This helps with the anti democratic part. I see how it goes. I also have to write 4 separate paragraphs on iron triangles. I need help with explaining how checks and balances was knocked off its course when the iron triangles set up conditions that may be exploited by corrupt politicians
an iron what? ive never heard of one
is it like a prison in the shape of a triangle? man this sounds like azkaban from herry potter
that's something similar to what i said in class today and everyone laughed. Here is my essay beginning: Our system of counterbalancing influences, by which organizations and systems are regulated, does not appear to be working well. James Madison intended to “push [Checks and Balances] farther.” The system was established to honor the key principle - separation of powers. Later on, the founders of the U.S Constitution realized that checks and balances along with division of power would be very helpful. The system would help maintain individual freedom and liberties. Madison was citing the American government’s structural features of characterization in several essays written by him and a group of Federalists. In one of the essays, he discussed the importance of the key principles in order for the government to do its duty well. Groups that make up an iron triangle are working in unison to formulate and implement policy in their area of interest. Existence of iron triangles disrupted the checks and balances. This system was disrupted by the triangles’ set up of conditions, which can be exploited by corrupt politicians, politicians serving personal political interest and _______ In the dynamics of a single iron triangle; interest groups provide lobbying support for agency programs to bureaucratic agencies that are friendly. (Tom Meltzer and Paul Levy- Publisher- Princeton Review) James Madison wanted the Checks and Balances to “operate is such a way by separating powers of different institutions ‘tyranny of the majority’ would be countered.” There were complications, which caused the system to function differently. . In truth, the iron triangles are nothing but the opposite of checks and balances. Checks and balances was knocked off its course when the iron triangles set up conditions that may be exploited by corrupt politicians.
