There is no collaboration between the Legislative and Judicial Branches prior to a Bill being passed by Congress. If/when the Bill is passed by both houses of Congress it is sent to the President who may sign it into law. ONLY WHEN IT BECOMES A LAW can the Judicial Branch rule on its Constitutionality - and then - only after it is appealed completely through the lower courts before it reaches them.
