What is the difference between a fact witness and an expert witness? A factual witness knows about the specific incident or crime. An expert witness knows about how things work for a particular aspect of the incident. For instance - car accident: Fact witness saw the accident Expert witness is an accident Reconstruction and can tell you how fast the cars were going based on skid marks and damage.
