A vestigial structure is one that serves little or no purpose. A structure without use should not be present at all, so it leads us to believe that some time in the past the species did use the structure or some form of it, otherwise it would not remain present in the species? So the genes are present because they were once useful, but are no longer. for example: whales have a pelvic bone. Useless to them now.
