All original works of authorship are copyright protected at the moment of creation. Some things like recipes, and facts, do not qualify. If someone has specifically dedicated something to the public domain, it is no longer protected. Works with expired copyright are no longer protected. Currently copyright lasts for 70 years after the life of the author. Even if a work is otherwise out of copyright, doing something like an updated translation can provide new protection.
