I'm doing a project on Robert Lindeux's Trail Of Tears painting and had this question to answer. It's from the view of a Native American man on the trail of tears. Sir, what are the cases of Cherokee Nation v. Georgia and Worchester v. Georgia? How do the cases relate to what is happening now?
These 2 cases establish the doctrine that Indian Nations are sovereign. That is, they are not subject to state laws and the Federal government is the only one that can deal with them. The Court ruled in favor of Cherokee rights. But president Jackson and others largely ignored the idea and did what he wanted. He removed them from the established states and made them live in the territories. Notice that these are well dressed people with nice stuff. The Cherokee were known as civilized. They did all they could to fit in with the Americans. But then, the Americans turned on them and kicked them out. The person you talk to would probably be very disappointed because he believed the American dream and then was shut out.
