It's a violation of basic human rights. This is a case of unlawful detainment or imprisonment. The Constitution guarantees the right of Habeas Corpus (produce the the body). If a person is not charged in a reasonable amount of time, a court can demand the person be brought to the court or released. The court order is called a writ of habeas corpus.
