The Department of Homeland security is a cabinet level department. This means it is part of the Executive branch, controlled by the president. When created, after 9/11, 22 domestic security agencies were gathered into it. Under the Constitution, Congress would be involved in the consolidation because it approves budgets and oversight for Executive departments and agencies.
