Bussiness Law When a minor breach has occured, the non-Breaching party is able to do what? The non-breaching party can sue for damages once the performance by the breaching party is complete. The non-breaching party can sue for the right to make the breaching party take corrective action for the breach. The non-breaching party can sue to recover damages caused by the defect plus the amount that the loss of oppurtunity is estimated to cost. The nonbreaching party can sue the breaching party to recover the cost of the repair that was required to correct the defect.
