The Judicial Branch sets penalties for lawbreakers. But that power is not absolute. The Executive has a check on the power to penalize by being able to set aside judgements s/he feels are excessive or unwarranted. The Legislative Branch can pass laws with a simple majority of each house. The Executive can check that power with a veto. But balance of power is kept by the legislative power to override the veto with a 2/3 majority in both chambers.
