Osmar Mendez - Vega Susan Wilson American Government 9/15/2020 Many people have different opinions on how the government and it’s Supreme Court decisions to the point where it has caused many problems and discussions; however, this what I think about this entire situation. The Supreme Court of the United States, established in 1789, is the highest federal court in the United States, with powers of a judicial review first asserted in Calder v. Bull (1798) in Justice Iredell's dissenting opinion. The power was later given a binding authority by Justice Marshall in 1803. The Supreme Court takes mostly all types of cases as long as it involves federal law, including the Constitution. Many people don’t like the idea of the Supreme Court because they think that it has too much power and some of its cases are done unfairly. However, on the other hand, people think that this type of power is necessary for them to have and all that power should be given to them. Charles Schneck was a General Secretary of the Socialist Party of the U.S., Schenck mailed 15,000 leaflets to draftees encouraging peaceful draft resistance. Schenck cited the 13th Amendment prohibiting involuntary servitude and the First Amendment right of free speech, press, and petition as validation for his actions. He was then sentenced to court and found guilty for violating the Espionage Act of 1917 by attempting to cause insubordination in the military and to obstruct recruitment and was then sentenced to 6 months in prison, however, I think that the Supreme Court was wrong for sentencing him to prison because even though he did do those activities, according to the First Amendment he has freedom of speech so technically speaking he didn’t break a law but practiced his First Amendment. The Supreme Court, in my opinion, did not let Schneck practice his first amendment because of what he was trying to do. I feel like in these times The Supreme Court takes advantage of its power and ignores the peoples and the constitutional right of the U.S in order to get what they want and that isn’t right for them to do. They use their power and since no one can stop them, they basically sometimes (not all the times) try to do what they think is right while ignoring important facts and rights. I don’t think that the Court should ever ignore these rights and it is never right for them to ignore because they were put there for a reason. So to conclude, what the Supreme Court did to Schneck was wrong and should not
