Gucchi:

A company decided to pass a policy banning cell phones on their property. A group of employees collected signatures to protest. Many of the co-workers who signed the petition were later fired because the petition was deemed disruptive. The employees sued the company, claiming their employer violated their constitutional rights. What is the likely outcome of this lawsuit? The employees will win because the Constitution prevents private companies from taking workers' phones. The employees will win because the Constitution guarantees the right to speak freely on a cell phone at work. The company will win because the employees are guilty of slander. The company will win because it is a private business and speech can have consequences in private places.

Gucchi:

Am I right with B?

Gucchi:

@smokeybrown

Razor:

In my personal opinion I support your answer since, a worker's phone is their property and what they do with it isn't the concern of the company's as far as property laws go and what the constitution allows and prohibits.

Razor:

That is of course unless the workers are planning some heist on those phones but - you know, not happening

Gucchi:

True, thank you

SmokeyBrown:

I think Razor has a point, but I'd like to offer a different perspective too. While the constitution does protect "free speech", this guarantee only says that people will not be limited in their speech *by the government*. A private business still has the right to make and enforce rules about the speech of their employees. For that reason, I think option D would be the best answer

Gucchi:

Yh that makes sense, thanks for the explanation. B was a great choice aswell, but i think D would be the answer

Razor:

Yeah XD I wasn't 100% sure how private companies operate so yeah D would make more sense

Gucchi:

Thank you both

SmokeyBrown:

=D
