with theta = 45 the electric flux would simply be equal to some value

k! it means it has nothing to do with something like max. flux or min. flux.

no! okay so assuming that we hold the magnitude of both the vectors constant and then only change theta we can see that the only function changeing the value of the dot product would be cos theta
