"Of the two brothers, he is the taller." There is no rule that is violated in this, but the (word of order) seems a little missed placed in this one. This syntax is smoother: "Of the two brothers". This will prepare the reader for the comparative adjective, to who is taller or "tallest" to the person or other personal, that they are comparing the taller or tallest person to.
