Well, first of all, the President of the United States does NOT have this power, and it cannot be given to him by Congress because the Supreme Court declared it unconstitutional in the case of Clinton v. City of New York, decided in 1998. If the President were to acquire this power in the future, it would probably have to be by constitutional amendment. Which seems very, very unlikely.
