Is there no copyright issues with all of these Owls people are making? Trademarks are trademarks, how is it legal because i am sure that permission has not been achieved.

OpenStudy (aripotta):

well preetha knows about it and she never told us to stop. in fact, she's encouraged us :] also, it's not like we're selling them and making a profit?

OpenStudy (anonymous):

You do not have to sell and make profit to break copyright and trademark laws though.

OpenStudy (aripotta):

as i look at it, it's fanart. and millions of people do fanart and i'm not aware of anyone getting in legal trouble over it?? (i might be wrong, idk) and we've got the permission of preetha, so i think all's ok

OpenStudy (anonymous):

Fanart is fan art which is legal...but they do not keep the credit, unlike how people do it on here when they keep all the credit.

OpenStudy (aripotta):

a lot of people sign their fan art and sean told me it was a good idea to do so. so whenever i give out an owl, there's a small "signature" in the corner, hardly noticeable, and all it says is "~Ari <3" i use the os owl as a template and then completely change it with gimp by drawing stuff in. it's the same shape, so that's all openstudy's. i'm not gonna take credit for that

OpenStudy (anonymous):

i am talking about the designs used...like spiderman, spongebob

OpenStudy (aripotta):

fan art! everyone knows the characters, that's why they're recognizable. idk what to say here??

OpenStudy (anonymous):

The credit is not given to whom the credit is deserved! WHo gets the credit for spiderman?! Spongebob?! Anything else fallen under trademarks!

OpenStudy (anonymous):

http://media.tumblr.com/tumblr_memz3v3ulZ1r4wepx.jpg

OpenStudy (anonymous):

i cannot view tumblr

OpenStudy (anonymous):

@Nachos 0.o

OpenStudy (aripotta):

when you look at fan art, they don't list every single credit! would you like it if i put "~marvel" under my name?? everyone knows it's based off a comic?!

OpenStudy (anonymous):

And those fan arts are breaking Copyright and Trademark laws! Just because it is inferred knowledge does not make it legal

OpenStudy (aripotta):

so what do you want me to do. what's the point in this

OpenStudy (anonymous):

Kegan, ʘ‿ʘ Just shut up. Ari is right.

OpenStudy (anonymous):

@Nachos 0.o

OpenStudy (anonymous):

i was simply asking. just try and give credit to the original authors. i do not want to see this site go under a lawsuit because of broken trademarks and copyrights

OpenStudy (anonymous):

The original author is her.. .-. She created it.

OpenStudy (aripotta):

people know i didn't come up with the idea and costume of spiderman..

OpenStudy (anonymous):

Inferred knowledge is not official credit. I am trying to help

OpenStudy (anonymous):

(╯°□°)╯︵ ┻━┻ You don't make sense. I can look at that and say "Oh, cool, she used Marvel's Spiderman"

OpenStudy (anonymous):

Nachos...your stupidity on what i am saying is intolerable. If you know nothing say nothing.

OpenStudy (anonymous):

It's not like Stan Lee is gonna make an account and say "Ari, I'm suing you for using my character without credit" because he can't~

OpenStudy (anonymous):

He absolutely can under federal trademark laws!

OpenStudy (anonymous):

(╯°□°)╯︵ ┻━┻ No.

OpenStudy (aripotta):

again, what would you like me to do

OpenStudy (anonymous):

I'm not being rude omfg. Mods give false warnings. Way to keep the site clean.

OpenStudy (anonymous):

He has every right to sue over his own property being used without credit! Just like a music artist can sue anyone who illegally downloads their music

hartnn (hartnn):

Nachos, if you can't be nice, don't comment.

OpenStudy (anonymous):

I am being nice. Get out~

OpenStudy (anonymous):

Nachos...leave the thread, you are not contributing, just wasting space

OpenStudy (anonymous):

I am contributing, because I make fan art all the time, so I'd know.

OpenStudy (anonymous):

DO you give proper credit? Because if not you can be submitted to legal involvement. I am not saying they have to stop. Just give credit to where credit is due.

OpenStudy (anonymous):

=_= Have you ever made fan art before?

OpenStudy (aripotta):

kegan what do you want me to do

OpenStudy (anonymous):

Just give credit. I would hate to see you all be submitted to legal review and possible lawsuits.

OpenStudy (anonymous):

That is all i am saying. You do not have to stop, just follow proper laws. They can legally have this site shut down if they wanted to because of trademark laws.

OpenStudy (anonymous):

There's no one to give credit to except Stan Lee and that's basically pointless because we all know who originally created Spider Man.

OpenStudy (anonymous):

Never underestimate the unpredictability of stupidity. Nachos you know nothing of this topic, you HAVE to give credit to Stan Lee because he came up with the idea!

OpenStudy (anonymous):

When I made fan art for a friend, I didn't have to credit the original because everyone knew what it was based off.

OpenStudy (anonymous):

Not the owl idea, but the fill ins used. NACHOS! Please read about inferred knowledge not being official credit.

OpenStudy (anonymous):

You obviously totally missed what I said.

OpenStudy (anonymous):

so did you...you missed the entire point of this thread

OpenStudy (anonymous):

Lol not at all

OpenStudy (anonymous):

So what is my point?

OpenStudy (anonymous):

That we need to credit people because just knowing who originally created the character isn't enough. Could probably do with rewording that, but Idgaf

OpenStudy (anonymous):

So why are you so opposed to credit? Just wondering, please enlighten me on this.

OpenStudy (aripotta):

fill ins? i drew all that stuff in? i didn't use a picture of spiderman. i used the paintbrush tool and drew it in.

OpenStudy (anonymous):

fill in does not mean only copy paste, but anything used to fill in a template

OpenStudy (anonymous):

I'm not opposed to crediting the person. But, like I said, there really is no point in doing it because we all know.

OpenStudy (anonymous):

Inferred knowledge does not take you fair in legal issues. Just like saying i thought the blinker was on when that car had to shoulder into the embankment. How would the police look at that? You ran someone off the road. Same can be said here. Inferred knowledge - "Well they know who it is" official credit takes precedence over inferred knowledge.

OpenStudy (anonymous):

pretty much it is plagiarism

OpenStudy (anonymous):

You're overlooking what I'm saying ffs.

hartnn (hartnn):

Guys drop the topic.

OpenStudy (anonymous):

So what are you saying? That there is no point in credit when i know who's it is?

OpenStudy (anonymous):

Mod said drop it, and I usually don't care what mods say, but I'll listen for once.

OpenStudy (anonymous):

@Hartnn it is closed 0.o now we are just discussing

hartnn (hartnn):

please don't ? on my request ?

OpenStudy (anonymous):

Very well :)

hartnn (hartnn):

Thank you :) _____________________________________________________________________________
