Affirmative action programs do not violate the Constitution. Racial quotas are necessary to correct for past discrimination. The Constitution forbids any government policy that uses a racial classification. Even states without official segregation policies must take steps to integrate their schools.
Bakke wanted to get in University of Mississippi. But he was rejected even though he had higher grades and test scores than the other whites who were accepted. Bakke sued for his entrance and led to something called "Affirmative Action." It is C. The court declared the act of the Regents unconstitutional and cannot use race as factor.
