Robert is a 22 year old man who is deaf. He is turned down for a job that he applied for at a local car wash business. The manager told him they could not hire him because he was deaf. Which law does this violate?
Passed by Congress in 1990, the Americans with Disabilities Act (ADA) is the nation's first comprehensive civil rights law addressing the needs of people with disabilities, prohibiting discrimination in employment, public services, public accommodations, and telecommunications.
Depending on the type of disability certain jobs may be discriminated against, such as dangerous jobs where being able to warn a person outside their visual field if their deaf. This may occur in certain jobs in construction, logging or any job where unexpected hazards occur. Even though the Act protects against discrimination a person still must be qualified for position and be able to handle any normal situation occurring with the job as lifting 100 lb bags. The only problem I have when they say theirs certain parts of the job they can handle is when a normal person on the job gets older these jobs should be for them not now being able to handle the rougher parts. Like on a construction crew where a woman holds the flag or drives the truck. I realize these jobs may not be as labor intensive as they once were but you should get the gist of what I'm saying.
