Several students created a page on the school’s web site that spoke out against a decision to cut funding to after-school activities. The page called for a protest that would take place off of school grounds, and not during school hours. The school took down the page. • Marbury Vs. Madison: The U.S. Supreme Court has the power to decide whether acts of the legislative branch violate the Constitution. The case established the judicial as an equal partner with the other branches • Plessy Vs. Ferguson: This is the case where the phrase “separate but equal" originated • Brown Vs. Board of Ed.: This case overturns Plessy Vs. Ferguson. Ends segregation in schools. • Gideon v. Wainwright: In criminal cases if someone cannot afford to hire their own attorney the court will appoint an attorney to represent them. • Miranda v. Arizona: As a result, police officers now read the Miranda warning to suspects before they are arrested. This helps ensure suspects understand they have the right to not answer questions, or say anything at all, if they choose. • Tinker v. Des Moines: “It can hardly be argued that either students or teachers shed their constitutional rights to freedom of speech or expression at the schoolhouse gate.” Explains how students were allowed to wear the armbands to protest the war. Students have rights as long as they do not interfere with another’s rights. • Hazelwood v. Kuhlmeier: A school may exercise great control over school-sponsored publications. • Censoring the articles was in the best interest of the school and students. • in re Gault: Those under the age of 18 accused of crimes in must be given many of the same rights as adults. This includes the right to know the charges, the right to confront witnesses, the right to remain silent, and the right to a lawyer. • Bush vs. Gore: In 2000, neither candidate won a clear 50% of Florida’s popular vote. A recount was called for, but two of Florida’s largest counties were unable to finish the count because they had different methods of recounting. Bush was declared the winner and awarded Florida’s electoral vote.
