I need to write a letter that will address three things in the following situation, out of these I cannot figure out this one: ◦the Constitutional amendment that relates to the situation This is the situation: ◦The federal government stated that local and state governments are solely responsible for the disaster recovery efforts and that it will not be providing assistance. Can you guys help me figure out which of the first ten amendments relates to this situation?

OpenStudy (anonymous):

The only amendment that I can see having anything to do with the interactions between the local, state, and national governments is the 10th amendment but that is preventing the national government from taking over the local and national governments, it doesn't say anything about a situation where the national government refuses to help the local and state governments.

@Preetha @whpalmer4 @Goku-Kai Any of you want to take a shot at it? Pretty Please?

OpenStudy (anonymous):

I guess I could flip the 10th around and say that the government cannot take over the state and local governments without their consent, it does have a responsibility to take care of them in certain circumstances.

OpenStudy (anonymous):

1) "The government allowed federal and state troops to be quartered in private residences to assist residents and protect order" This violates the Third Amendment - "No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law." Argument for this situation: the troops would be close to the area of the disaster and would then be more effective in rendering aid and keeping order. Argument against: Forcing people to keep unwanted visitors in their homes is an affront to the very idea of personal property and privacy. My position: A property owner should not be deprived of the right to enjoy his or her property as he or she sees fit. Also, forcing troops into homes like this would likely anger citizens and troops would then not receive any positive aid from the locals. 2) "Citizens were denied the right to bring legally owned firearms to storm shelters" This violates the Second Amendment - "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." Arguments for: Bringing firearms to storm shelters, being safety areas during a disaster, may bring violence into a place that is designed as a sanctuary. Argument against: Most people are good, some are bad. A person who legally owns a firearm should be allowed a means to protect him or herself at any time in any place. My position: Firearms serve an important part in American society. They keep governments in check, they ward off some other citizens with hostile intentions, and they serve as a reminder that each one of us has the right and duty to protect the nation from our own government if necessary. Denying a person access to their lawful firearm is effectively giving ultimate power to government with absolutely no checks or balances from the people. Goku-Kai, that doesn't help me, it doesn't explain this choice. :(

OpenStudy (anonymous):

Hmm... does this help? http://openstudy.com/study#/updates/52caa99ee4b09cbacd60cb93

@Goku-Kai sorry I took so long, I was helping my mom bake, yes that should help. :)

This is what I ended up writing, how does it sound? Firstly I would like to address the issue of the National Government refusing aid to the local and state governments of my state. I understand that the 10th Amendment prohibits the National Government from taking control of the State or Local Governments without their consent, however the unspoken side is that the National Government has a responsibility to protect and care for its States and Citizens in circumstances that involve large portions of the state or nation and not just one or two counties. I know it needs some editing but how does it sound?

OpenStudy (anonymous):

As of now it sounds good if you would like to go over this with your teacher before you send it in read it to him/her over the phone or webmail it to him/her and make clear that you are not sending it in but just wanted to make sure that it is correct :)

I can resubmit it any number of times without it affecting my final grade. :) Thanks for your help. By the way, I love your user name! :) Does it mean anything?

OpenStudy (anonymous):

Cool and Thanks. It is a character by the Name of Goku in the Anime series Dragon Ball Z. He is a very nice character who loves the world. Literally, from people to Animals to plants and the air. If anyone decides to try and do wrong to the earth he is there to protect it. I feel as though that is how I am in some way. Very Caring, loving and has a free spirit just like Goku. Kai means "strong" or "unbreakable" It is also one of several meanings, including "triumphant". But that is why I chose this name lol

OpenStudy (anonymous):

My real name is Jay though, just so you'll know ;)

OpenStudy (anonymous):

Cool, mines Renee` :) My anime ranges from Bleach to Kazema no stigma, and a little bit of soem others. :)
