The Cherokee were a very sophisticated tribe in the early 1800s. They had always been great friends and allies of the United States. May were well educated. They lived in homes much like those of whites. When settlers started to encroach on Cherokee Lands in Georgia and the Carolinas, The Cherokee responded with the law rather than violence. There was a lot of give and take, success and failure but Cherokee Nation vs Georgia went to the Supreme Court. The Cherokee were asserting their right to property the same as any American. The court refused to hear the case and effectively let the Cherokee down. They did every thing they could to assimilate and work with the US according to it's laws. Then when they needed the support, it was not there. The Worchester case dealt with Georgia's attempt to keep settlers off of Cherokee land. Worchester was arrested for trying to settle on Cherokee land without pemission of the State. This one backfired. The court found that Indian Nations can't be dealt with by individual states. Even though this State Law was trying to help the Cherokee. Anyway it established the legal doctrine that Indian nations are sovereign and have to be dealt with by the US government and not state governments.

This is a scene from the Trail of Tears. President Jackson came up with the Indian Removal act. Through some political maneuvering and deals with some Cherokees, Jackson got the tribe to sign on to moving all Cherokees to what is now Oklahoma. Those two cases and the Indian Removal Act are betrayals of our friends. Here was a people who welcomed us, took part in capitalism, supported us in the Revolution and did all they could to play by our rules. Still they ended up treated about the same as if they had been fighting us the whole time. The guy that the arrow points to is well dressed. Probably a tribal leader. These people are being forced from their modern (at the time) homes into the wilderness. The supplies and transport promised by the US didn't fully materialize. They are crossing and area with lots of rivers and streams, including the Mississippi without many bridges. Conditions were terrible. So the guy, probably a leader, knows all the background and needs to take care of the needs of his people as best he can.
