Alvarez-Machain established that detainees do not have protection per the Geneva Conventions. The U.S. Supreme Court case Hamdan v. Rumsfeld established that part of the Geneva Conventions do protect the detainees.

On July 7, 2006 the Secretary of Defense issued a memo "Application of Common Article 3 of the Geneva Conventions to the Treatment of Detainees in the Department of Defense". This may be the basis of a July 11, 2006, statement by the Bush administration that all detainees at Guantanamo Bay and in U.S. military custody everywhere are entitled to humane treatment under the Geneva Conventions
