The president has broad powers to set policy, but cannot simply do as seems pleasurable. Foreign treaties must be ratified by the Senate, for example. The Judicial should NOT set policy, but they often do. It is a demeaning term known as "Legislating from the Bench". Give the War Powers Act a good read. The president can send in a marine division, but congress is needed to fund any prolonged activity. I think the correct answer would the President, but with some explanation necessary. To see the power of the President, one must only look at the results when parties change in the Whitehouse. One of the first tasks is to decide which Presidential Orders (from the previous administration) to revoke.

It takes 38 states. 38/50 = 76% (Really 3/4 or greater) There is also a "Constitutional Convention", but that has never happened to amend the US Constitution.
