OpenStudy (spudmushie123):

Is there an overlap between a patent, copyright, and a trademark? How long do they each last?

OpenStudy (spudmushie123):

OpenStudy (e.mccormick):

Have you looked at any of the info on it from the Patent and Tradmeark Office?

OpenStudy (neonumbrella5115):

Well, A patent lasts 20 years and a copyright usually lasts from 95 to 120 years. A trademark lasts as long as its used.

OpenStudy (spudmushie123):

@e.mccormick Yes. I found some things, but was wondering if anyone knew the specifics of this question, particularly the overlap.

OpenStudy (spudmushie123):

I am in a group where we invented a device, and we are working on getting it patented.

OpenStudy (e.mccormick):

Well, there is a FAQ thing rather on that page about the differences between them.

OpenStudy (e.mccormick):

As for overlap, they don't past the fact that they protect rights of their owner. Seel, they protect different things. So if you get the wrong one, it does not help.
