It is not toxic to the ozone layer. It is not one of the compounds that can cause ozone depletion. Carbon dioxide is a green house gas that traps heat. Coal burning also releases several other compounds into the air, some of which can cause ozone depletion. The sulfur impurities in coal can cause acid rain when the fumes from coal burning are not properly managed.
