I think it's BS. You can limit the rights of a person to do the activity if it is deemed too harmful to other human beings, but banning something outright because of "what if" is always wrong. It's possible to ban smoking in public domains and/or places all humans have to share, but to just make it illegal will makes things worse not better. It's not the responsibility of society to dictate the way life works in all aspects - it's only society's collective job when an activity may harm more than just the participate in a public form. If someone smokes in their house, fine. In a hospital? No. It all depends on "what" the activity is and the context and what effects it has on people not participating. If it only effects the participates then have it as long as the participates 100% understand the effects of the activity.
