Final decision: Does this mash-up qualify as fair use? Why, or why not?

Hoodmemes:

it was a turn it down for what mashup including a bunch of artists with only clips from their songs

Vocaloid:

This is somewhat of a legal gray area and there's a lot of conflicting information on this. However, I think the argument is stronger for mashups *not* being fair use. There's a 2005 case called Bridgeport Music v. Dimension Records (in which a short clip from a song was used in a movie without copyright permission). I'll cite some references that go into more details https://ogs.law/copyright/mashup-is-it-legal/#:~:text=Some%20sampling%20is%20%E2%80%9Cfair%20use,isn't%20one%20massive%20sample https://cyber.harvard.edu/people/tfisher/IP/2005%20Bridgeport%20Abridged.pdf

Vocaloid:

sorry, forgot to mention, the court ruled against using the song being fair use, since the original song creator had the exclusive rights to reproduce their song, even such a short amount.

Hoodmemes:

So say these clips of turn it down for what is like 6 seconds long it would still be illegal?

Vocaloid:

Actually, yes, according to my research, it's not the length of the clip that matters, so even short clips are copyright protected

Hoodmemes:

oh ight thx

Just to be safe I'm going to tag a few other people for their opinions @AZ @Shadow, if you have a spare moment
