third question srry, why was Marbury v. Madison such an important case? think about it .Judge marshall's decison .its effect of the future

OpenStudy (anonymous):

It establish the courts ability to rule if something was constitutional.

OpenStudy (wach):

Yes. Let me explain.

OpenStudy (anonymous):

okay

OpenStudy (wach):

Yes - Judicial review is EXTREMELY important. It marks the separation of powers between the judiciary, executive, and legislative branches of the government which prevents one party from accumulating to much power - checks and balances, if that makes sense. Marbury vs Madison is perhaps the most IMPORTANT court case ever, since it basically establishes this principle. Asides from balancing government and making it more democratic and fair, judicial review leaves room for the changing of laws. This is really important, since the world and society does change. For example, alcohol used to be illegal by an Amendment, but this was amended because alcohol prohibition caused huge surges in crime.

OpenStudy (anonymous):

Without Judicial Review we would have even more ridiculous laws, with lots more flaws in them! It has to be reviewed to make sure it is for the common good. I think it is very important.

|dw:1365194958344:dw| SORT OF MESSY SORRY
