Locke was all about social contract, the idea that the people have the right to change their government if their government did not fulfill its purpose. So the first answer would be right. :)

As for the second, I'm not sure, but I would say that the second one seems like it. There were a few instances where states had cases against the feds because the feds declared a law that particular states didn't like. :3
