A judge must rule based on his/her judgement on the facts to weather or not a person is guilty so I would say the first option is correct

its not D, because D is saying that the judge is in the right by judging based on personal preference, it is A because A is saying that everyone else needs to judge fairly and it is not fair for one judge to violate the law and rule a punishment based on his personal preference.
