The first principle of American Government (and Constitutional Law) is that only elected officials should be allowed to make laws. Judges are appointed; presidents, senators, etc. are elected. According to the Constitution, judges only give an OPINION (when referring to constitutional law) whereas presidents, etc can make the laws.
