The Preamble to the Constitution begins with the words “We the People.” This collective “we” did not extend to the right to vote for women, African Americans, or Native Americans. How does the amendment process reflect the importance of an independent judiciary review and the rule of law?

@wwhitlock could you help me understand this one?

OpenStudy (wwhitlock):

yes, it's an awkward sentence. It will take me a minute to figure out what they want. Working.

@wwhitlock okay, thank you so much.

OK. I'm gonna throw out some ideas and see if we can make sense of this. So it will probably look like random ideas. The amendment process allows for changes it the Constitution but doesn't make it too easy. Congress and the several states have to work together. So amendments come from the people representatives at both levels. Judicial review is a check on congress and the president. The people's power is above that. But it's much harder for the people to remove judges than any other Constitutional official. So if the an amendment gets struck down be judicial review..... No the judiciary can't strike down and amendment because it would be part of the Constitution. Judicial Review uses the Constitution as the standard when reviewing acts of the pres or congress or the states. Let's try rule of law. Amendments are meant to change the law. So that shows the importance of the rule of law. Amendments are not easy to pass so we don't just change the law at the whim of some ruler (That's why President Obama is running into problems with his executive orders. The Constitution doesn't like that.) That's what I've got so far. This one is making me think. Thanks for the challenge. I'll keep working on a better answer. Maybe this much will help though.
