All three branches are supposed to uphold the Constitution.
The courts exercise judicial review, passing judgment on whether Congress did pass a law that exceeds the powers delegated to it, and the courts do that IF someone has a lawsuit challenging the law.
But the members of Congress, too, have sworn an oath to uphold the Constitution, and they should not vote for laws that violate it. They should predict whether or not the courts would strike down the laws that they pass. The President should veto bills that are unconstitutional.
