tricky one. Let's think it out. The 1st amend doesn't cover libel or slander. If you say or print something you know is a lie and some body can prove damage from your speech, it's not covered. Political candidates and public figures get untrue things said about them all the time. It has to be pretty bad to go to trial. I'm just thinking this out. So what have we learned.?

No branch of the govt has express permission to restrict rights. But laws are necessary to have civilization. The legislative branch is the one that makes laws.

The DoI mentions inalienable rights. Rights that we just have. Jefferson uses the term endowed by our creator with inalienable rights. But the Enlightenment thinkers wouldn't neccesarily mention the god part. They would agree though that we just naturally have rights.
