The 5th Amendment had an impact on Miranda V. Arizona? O. True or O. False

Convert:

In Miranda V Arizona it talked about Miranda and how he was not read his 5th Amendment rights and confessed to his crime and even though he had commuted his crime, because he was not read his 5th amendment rights and his ability to remain silent if he wanted to, the Supreme Court found this to be unconstitutional. Because of this I would say yes the 5th amendment had a big impact on the Miranda V Arizona case and although he still went to jail it showed just how important reading the 5th amendment to arrested persons is.

Hoodmemes:

Which is correct?

Convert:

"n the landmark supreme court case Miranda v. Arizona (1966), the Court held that if police do not inform people they arrest about certain constitutional rights, including their Fifth Amendment right against self-incrimination, then their confessions may not be used as evidence at trial."

Convert:

I still believe it is True based on that information.

mxddi3:

Yeah, based on what he/she said, i'd go true because Miranda was not read his rights, so his confession could not be used against him. If you think, when you hear "you have the right to remain silent. Anything you say can and will be used against you in a court of law..." these are known as your Miranda Rights : )
