I'm guessing that they probably have to first add the area of all inscribed squares.

Then they need to add in possible "cut-off" squares as half-area of a unit square.

I found 38 Squares by adding some of the side squares

ohh i found the same thing by just using the equation of the area of circle so i counted the diameter of the circle and it was 7 so the radius is half of the diameter so its 3.5 so the area of the circle is pi*3.5^2=approx 38.5
